The Professional Educator Standards Board (PESB) has rulemaking authority for preparation, certification, continuing education, and assignment for Washington state certificated educators under Chapter 28A.410 RCW. Rules developed by PESB can be found in Title 181 WAC. Questions regarding these rules can be directed to PESB rules coordinator Michael Nguyen.
The Paraeducator Board has rulemaking authority for paraeducator minimum employment requirements, standards of practice, certificate program, and career ladder under Chapter 28A.413 RCW. Rules developed by the Paraeducator Board can be found in Title 179 WAC. Questions regarding these rules can be directed to Paraeducator Board rules coordinator Tristan Wiley.
Participate in rulemaking
PESB and the Paraeducator Board may use work groups, subcommittees, and board meetings to help develop rules. Please see guidance on submitting public comment for PESB or Paraeducator Board rules. Rules are heard at upcoming PESB and Paraeducator Board meetings.

Rulemaking process
Information on rulemaking is available through the Office of the Code Reviser. To adopt rules (also known as Washington Administrative Code, WAC, or regulations) all Washington state agencies must follow steps that are described in the Administrative Procedure Act and regulations.
Current Rulemaking Activity
CR-103P Permanently adopted rules
A CR-103P order to adopt the permanent rule is the last step in the rulemaking process. The CR-103P notice includes the full text of the rule being adopted and lets the public know when the rules will become effective.
CR-102 Proposed rulemaking. Public hearing scheduled.
The CR-102 proposed rulemaking notice gives details about the rules PESB or the Paraeducator board is considering for adoption, and includes the text of the proposed rules. The CR-102 gives information on the public hearing.

CR-101 Preproposal statement of inquiry
The CR-101 Preproposal Statement of Inquiry is the first official notice needed to start most rulemaking actions. The CR-101 announces that PESB or the Paraeducator board is planning to consider rules on a particular topic.
CR-103E Emergency adoption
PESB or the Paraeducator Board may adopt emergency rules under certain specific conditions. Emergency rules are temporary, and are effective for a limited period of time. These rules cannot become permanent unless the regular rulemaking steps are followed.
CR-105 Expedited rulemaking
This shortened process allows PESB or the Paraeducator Board to adopt or repeal a rule in very limited circumstances.
